CONDITIONS, LIMITATIONS AND EXCLUSIONS

Right to Cancel – The policy contains a 30-day free look period.

Renewability – The policy is renewable to age 95.

Contestability – Assurity has the right to contest the validity of the policy or any attached riders based on material misrepresentations made in the application. Assurity cannot contest the validity of the policy or any attached riders after it has been force for two years from the issue date, except for fraudulent misstatements made in the application, when permitted by the law of the state where the policy is issued.

Suicide – If the insured person dies by suicide within two years of the issue date or two years of the last reinstatement date, Assurity’s liability is limited to a refund of premiums paid, less benefits paid under any riders.

Misstatement of Age and/or Gender – If the insured person’s age and/or gender (if the policy was issued on a gender-distinct basis) is misstated in the application, Assurity will revise the policy and any applicable riders’ benefit amounts to the amount the premium would have purchased for the correct age and/or gender.

Termination – The policy will terminate the earliest of the following: when premium is not paid by the end of the grace period; the date the face amount is less than $25,000 due to conversion; the date Assurity receives written notice to terminate; upon the insured person’s death; or on the expiration date listed on the policy schedule.

Riders may contain additional conditions, limitations and exclusions.

Availability of this product, and its benefits and premiums as presented, is subject to the approval of Assurity Life Insurance Company. Final medical and financial underwriting requirements and cost will depend on your application. A medical exam is required for monthly benefit amounts of $4,001 and greater for issue ages 18-50, $2,001 and greater for issue ages 51-55 and $1,501 and greater for issue ages 56-60.

Limitations and Exclusions

The following limitations and exclusions apply to the policy as approved in most states. Limitations and exclusions may vary by state.

Limitations

Foreign Travel and Residency

Assurity will pay up to a maximum of three disability monthly benefits for any disability sustained or continued outside the United States or Canada

Mental/Nervous Disorders; Substance Abuse

Assurity will pay up to a maximum of 24 disability monthly benefits during the insured’s lifetime for disabilities due to mental/nervous disorders and substance abuse.

Pre-existing Condition

If the insured’s disability is within two years from the issue date and is due to a pre-existing condition, no benefits will be paid unless the condition was disclosed and not misrepresented on the application and is not excluded by a policy amendment rider. 

A pre-existing condition is a sickness or physical condition for which, during the two years before the issue date, the insured:

•    had symptoms which would cause an ordinary prudent person to seek diagnosis, care or treatment; or

•    received medical consultation, advice or treatment from a physician or had taken prescribed medication.

Exclusions

Assurity will not pay benefits for conditions that are caused by or the result of the insured:

•    being pregnant, experiencing childbirth or having an elective abortion (complication of pregnancy is deemed to be a sickness);

•    losing an occupational or professional license or certification;

•    being exposed to war or any act of war, declared or undeclared;

•    engaging in an illegal occupation;

•    participating in or attempting to commit a felony;

•    intentionally self-inflicting a sickness or injury;

•    committing or attempting to commit suicide, while sane or insane;

•    being incarcerated or is caused while incarcerated in a penal institution or government detention facility;

•    being intoxicated (as determined by the laws governing the operation of motor vehicles in the jurisdiction where the disability occurs) or under the influence of an illegal substance or a narcotic (except for narcotics used as prescribed to the insured by a physician); or

•    actively serving in any of the armed forces, or units auxiliary thereto, including the National Guard or Reserves, except during the active duty training of less than 60 days.

Universal Life Disclosures

Policy Form No. I L1921 and Rider Form Nos. R I1420, R I1421, R I1422, R I1423, R I1424, R I1425, R I1427, R I1428, R I1429, R I1430 and R I1922 underwritten by Assurity Life Insurance Company, Lincoln, NE.  

1. Policies have minimum and maximum premium amounts that you must meet in order to maintain your coverage.

2. Interest rates are declared monthly and are based on company earnings.

3. Accelerated Death Benefit Rider is included in states where allowed. The chronic illness benefit is included through issue age 75. Accelerated benefits reduce the death benefit.

4. A withdrawal or policy loan will reduce your death benefit amount by an equal amount. A minimum amount must be retained to keep the policy in force. Withdrawals are subject to a fee. Assurity charges interest for policy loans, but also credits interest on any portion of the amount that is loaned. Under current tax law, policy loans are not subject to income tax. Tax questions must be referred to a qualified tax advisor.
